IMPORTANT NOTICE: NO CLOUD BACKUP & DATA LOSS RISKS

THE LEAPTIC APP FUNCTIONS PRIMARILY AS A LOCAL TOOL FOR YOUR CAMERA. PHOTOS AND VIDEOS TRANSFERRED FROM YOUR CAMERA TO THE APP ARE STORED LOCALLY ON YOUR MOBILE DEVICE’S INTERNAL STORAGE. WE DO NOT AUTOMATICALLY BACK UP THIS CONTENT TO THE CLOUD. IF YOU DELETE THE APP, CLEAR ITS CACHE, OR LOSE YOUR DEVICE, YOUR FOOTAGE MAY BE PERMANENTLY LOST. LEAPTIC IS NOT LIABLE FOR SUCH DATA LOSS. PLEASE ENSURE YOU REGULARLY BACK UP YOUR MEDIA TO A SEPARATE STORAGE DEVICE OR CLOUD SERVICE.

1. ACCEPTANCE, FREE ACCESS, AND PAYMENTS

1.1. Acceptance of Terms

These Terms of Service (the “Terms” or “Agreement”) govern your access to and use of the Leaptic mobile application, embedded firmware, and related digital services (collectively, the “App” or “Services”), provided by Shenzhen Photon Leap Technology Co., Ltd, a company incorporated under the laws of the People’s Republic of China (PRC), with its registered address as set forth in Section 23 (“Leaptic”, “we”, “us”, or “our”). By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App. These Terms apply to users habitually resident in the European Union (EU), European Economic Area (EEA), and Switzerland. Nothing in these Terms affects any mandatory statutory rights you may have as a consumer under the laws of your country of residence.

1.2. Free Access

The App is currently provided to you free of charge. However, access to the App requires a compatible Leaptic camera device, which must be purchased separately.

1.3. Future Paid Services

Leaptic reserves the right to introduce paid features, premium subscriptions, or digital items ("Paid Services") in the future.

1.3.1 Notice: We will not charge you for any Service unless you have explicitly agreed to the applicable fees and payment terms. We will provide you with reasonable advance notice of any new fees.

1.3.2 Taxes: All fees are inclusive of VAT and applicable taxes unless stated otherwise.

1.4. Third-Party Fees

You are solely responsible for any data charges or internet access fees incurred while using the App, as charged by your mobile network provider.

2. ELIGIBILITY AND AGE REQUIREMENTS

2.1 Minimum Age

Access to and use of the App is strictly limited to individuals who are thirteen (13) years of age or older. The App is not intended for, and may not be used by, children under the age of 13 for any purpose, including as a tool, utility, or support instrument. By accessing or using the App, you represent and warrant that you are at least 13 years of age. If we become aware that a child under 13 has provided us with personal data or is using the App, we will take immediate steps to delete such information and terminate the account or access.

To access the Social Community features of the App (including viewing, liking, commenting, or posting content), you must be at least sixteen (16) years old. By using these features, you represent that you meet this age requirement.

2.2 Dual Eligibility (Tool vs. Platform)

If you are between the ages of 13 and 16, you may use the App solely as a Local Tool (camera control and local editing) under the direct supervision of a parent or legal guardian. You are strictly prohibited from creating a cloud account or accessing Social Community features.

2.2.1 Privacy Note: Use of the App in "Local Tool" mode is designed to minimize data collection and does not involve the processing of personal data for behavioral profiling or advertising targeting.

2.3 Verification

Leaptic reserves the right to verify your age and may suspend or restrict your account to "Local Tool Mode" if we are unable to verify that you meet the age requirements.

3. ACCOUNT REGISTRATION AND SECURITY

3.1 Registration

To use the Social Community features, you must create an account ("Account") via Phone, Apple ID, or third-party social credentials. You agree to provide accurate, complete, and up-to-date information.

3.2 Security and Responsibility

You are strictly responsible for maintaining the confidentiality of your login credentials and for all activities carried out through your Account. You must not disclose your password or authentication credentials to any third party. You acknowledge that any activity performed through your Account will be deemed authorized by you unless you have notified us of a breach. Leaptic is not liable for data loss or damages arising from your failure to secure your Account credentials.

3.3 Inactivity

To maintain system hygiene, Leaptic reserves the right to terminate or deactivate Accounts that have been inactive for a continuous period of 24 months.

3.4 Single Point of Contact

Pursuant to Articles 11 and 12 of the Digital Services Act (Regulation (EU) 2022/2065, DSA), we have designated a single point of contact for users and Member State authorities. Please refer to Section 23 (Contact Information) for these details.

4. PRIVACY POLICY

Your privacy is important to us. Please review our Privacy Notice to understand how we collect, use, and store your data. You acknowledge that the Privacy Notice is provided for information purposes and explains our data practices, but does not form a contractual part of these Terms.

5. SCOPE OF SERVICES: THE TOOL AND THE PLATFORM

The App provides two distinct types of services. Your rights and our obligations differ depending on the function used.

5.1 The Tool (Local Camera Control & Editing)

The App functions as a local controller and editor for compatible Leaptic cameras.

5.1.1 Camera Connectivity: The App enables you to connect compatible camera devices via Bluetooth/Wi-Fi, control camera functions, and transfer media to the App.

5.1.2 Local Storage: Media is stored on your phone's internal memory. Leaptic does not possess a copy of your raw footage unless you explicitly upload it to the Community. You are solely responsible for creating external backups.

5.1.3 Firmware Updates & Safety: The App facilitates firmware updates. You are responsible for following all instructions (e.g., battery levels) during updates.

WARNING: The Firmware contains safety-critical functions. As strictly prohibited in Section 10.4, you must not modify or reverse engineer this software. Doing so may compromise thermal management or battery safety, leading to hardware failure or injury.

5.2 The Platform (Social Community)

The App includes hosting services allowing you to interact with other users.

5.2.1 Hosting Service Status: Leaptic acts as an "Intermediary Service" (Hosting Provider) under the DSA. We do not guarantee that the Platform will be error-free or available at all times.

5.2.2 Not a Marketplace: The Social Community is for social interaction only. You may not use the Platform to conclude binding sales contracts with other users or to offer goods/services for sale directly through the App interface. Leaptic disclaims any status as an "Online Platform allowing consumers to conclude distance contracts" under DSA Article 30.

5.3 Automated and AI-Assisted Functions

AI Editing: The App provides automated editing tools which analyze user-provided content to generate edited outputs (“AI-Generated Content”). See Section 6 for specific disclaimers.

6. AI-GENERATED CONTENT DISCLAIMER & INDEMNITY

6.1 Nature of AI

When using AI editing functions, you acknowledge and agree that:

6.1.1 Automated Process: AI-Generated Content is produced automatically by machine learning models based on the input you provide and does not involve human review or editorial oversight by Leaptic;

6.1.2 Probabilistic Nature: AI-Generated Content is inherently probabilistic and may contain errors, omissions, artifacts, or subjective selections;

6.1.3 No Warranty: Leaptic makes no representations or warranties regarding the accuracy, completeness, or suitability of AI-Generated Content for any particular purpose;

6.1.4 Not Professional Advice: AI-Generated Content is provided for creative purposes only and should not be relied upon as a substitute for independent judgment.

6.2 Transparency and Markings (EU AI Act)

In accordance with the EU AI Act (Regulation (EU) 2024/1689) and other applicable laws, AI-Generated Content may include embedded metadata, digital watermarks, or other machine-readable markings to identify its artificial origin. You agree not to remove, obscure, or tamper with these markings, as they are intended to ensure transparency for third-party platforms and users.

6.3 User Responsibility & Indemnity

You are solely responsible for how you use AI features. You agree to indemnify and hold Leaptic harmless from any claims arising from your use of AI features to generate content that is illegal, defamatory, or infringes on the rights of third parties. This explicitly includes, but is not limited to, the creation of "deepfakes," Non-Consensual Intimate Imagery (NCII), or content that manipulates the likeness of a person to deceive the public.

7. OWNERSHIP AND INTELLECTUAL PROPERTY

7.1 App Ownership

The App, including all software, source code, object code, architecture, algorithms, user interface, design, and features (excluding User Content), are protected by copyright, trademark, and other intellectual property laws. Leaptic and its licensors retain all right, title, and interest in and to the App.

7.2 Text and Data Mining (TDM) Reservation

Leaptic expressly reserves the right to prohibit text and data mining of content available on the App (including User Content) for the purposes of training third-party artificial intelligence systems, in accordance with Article 4(3) of Directive (EU) 2019/790. Commercial scraping of this App is strictly prohibited.

8. ACCESS TO DEVICE-GENERATED DATA (DATA ACT)

8.1 Data Rights

In accordance with Regulation (EU) 2023/2854 (The Data Act), you have the right to access the "product data" and "related service data" generated by your use of the Leaptic Camera and App

8.2 Access & Portability

You may access this data via the "Download My Data" function in Account Settings. Additionally, you may request us to share this data directly with a third party of your choice. Leaptic will facilitate this request provided it is technically feasible and does not compromise the security of the product or the trade secrets of Leaptic.

8.3 Limitations

Leaptic reserves the right to withhold data if sharing it would undermine the security requirements of the product or violates the intellectual property rights of Leaptic or others. You warrant that you will not use this data to develop a competing product.

9. USE OF USAGE AND TECHNICAL DATA

9.1 Usage Data

Leaptic may collect technical performance data (e.g., crash logs, battery health, connection stability) to maintain and improve the Services.

9.2 Derived Data

We may create aggregated, anonymized, or de-identified data ("Derived Data") from your usage. You agree that Derived Data does not constitute your personal data or confidential information, and Leaptic owns all rights to such Derived Data for business and development purposes (e.g., training algorithms to improve image stabilization).

10. LIMITED LICENSE

10.1 License Grant

Subject to your continued compliance with these Terms, Leaptic grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on your mobile device.

10.1.1 Software Use (Personal): The license to use the App software itself (including the interface, source code, and editing tools) is solely for your personal, non-commercial purposes. You may not sell, rent, lease, or sublicense the App software to others.

10.1.2 Content Use (Commercial Exception for Creators): Notwithstanding the above, you may use the photos and videos created, edited, or exported using the App ("Created Content") for both personal and commercial purposes (e.g., posting on monetized social media channels, vlogging, professional portfolios). HOWEVER, this permission is strictly subject to the Music License restrictions in Section 11.5. If your video contains Background Music (BGM) provided by the App, that video is licensed solely for personal, non-commercial use unless the specific music track is explicitly marked in the App as "Commercial-Cleared."

10.2 Restrictions

You may not, directly or indirectly:

10.2.1 Reverse engineer, decompile, or disassemble the App, except to the extent such restriction is explicitly prohibited by applicable law (e.g., for interoperability purposes under Directive 2009/24/EC);

10.2.2 Use the App to create a competing product or service;

10.2.3 Sideloading: Install the App from unauthorized sources. Leaptic is not liable for security breaches, data loss, or malfunctions resulting from the use of unauthorized or modified copies of the App;

10.2.4 Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) included in the App.

10.3 Third-Party Components

Certain components of the App may be subject to open-source or other third-party license terms. To the extent required by such licenses, the terms of the third-party license will apply in lieu of these Terms with respect to those specific components.

10.4 Safety Critical Software & Substantial Modification

The App and embedded Firmware may contain safety-related functions (e.g., battery management, thermal limits, stabilization algorithms). You agree not to modify, reverse engineer, or "sideload" unofficial versions of this software. WARNING: Any unauthorized modification to the App or Firmware constitutes a "substantial modification" under the EU Machinery Regulation (EU) 2023/1230. If you perform such a modification, you acknowledge that you become the legal Manufacturer of the modified product, assuming full legal responsibility for its compliance and safety. Leaptic shall not be liable for any injury, property damage, or hardware failure ("bricking") resulting from such modifications.

11. USER CONTENT AND PERMISSIONS

11.1 Ownership

You retain ownership of all photos, videos, comments, reactions, and other content that you create, capture, upload, post, or otherwise make available through the App (“User Content”). Leaptic does not claim ownership of your User Content.

11.2 License to Leaptic

By uploading, posting, or otherwise making User Content available through the Social Community features of the App, you grant Leaptic a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, format, display, and distribute such User Content for the limited purposes of:

11.2.1 Operating and providing the Services (e.g., displaying your video to your followers or formatting it for different screen sizes);

11.2.2 Improving the Services, including training internal machine learning algorithms (AI) to improve image recognition and editing tools (subject to applicable privacy laws); and

11.2.3 Promoting the App (e.g., highlighting "Featured Videos" on the home screen), subject to your account privacy settings.

11.3 Moral Rights Waiver

To the extent permitted by applicable law, you waive any "moral rights" or similar rights (such as the right to be named as the author or the right to object to technical modifications) in your User Content to allow Leaptic to technically format, compress, and display your content across different devices and platforms without legal friction.

11.4 Third-Party Image Rights

You represent and warrant that if your User Content contains the image, voice, or likeness of any identifiable individuals, you have obtained their explicit consent to use their likeness in the manner contemplated by these Terms.

11.5 Background Music License (Important Limitation)

The App may provide access to a library of licensed music ("BGM") for use in your videos.

11.5.1 Personal Use Default: Unless a specific music track is explicitly tagged in the App interface as "Commercial Use Allowed," you are granted a license to use BGM solely for personal, non-commercial use.

11.5.2 Commercial Restriction: You may not use videos containing non-commercial BGM for sponsored content, advertisements, or on monetized social media channels (e.g., YouTube Partner Program) where the platform may claim rights to the audio.

11.5.3 Platform Risks: Leaptic provides the music on an "AS-IS" basis. We do not guarantee that third-party platforms (e.g., Instagram, TikTok) will not block, mute, or demonetize videos containing this music due to their own territorial licensing restrictions. You are solely responsible for clearing rights for commercial distribution on third-party platforms.

12. ACCEPTABLE USE AND DSA COMPLIANCE

12.1 Prohibited Content

You agree not to upload, post, or share content that is illegal or prohibited, including:

12.1.1 Terrorist Content: As defined by Regulation (EU) 2021/784 (the "TERREG"). Leaptic enforces a zero-tolerance policy for Terrorist Content. In accordance with Article 3(3) of the TERREG, we are legally required to remove or disable access to terrorist content within one (1) hour of receiving a removal order from a competent authority.

12.1.2 CSAM: Child Sexual Abuse Material or any content exploiting minors.

12.1.3 Hate Speech: Content inciting violence or hatred based on race, religion, gender, sexual orientation, or disability.

12.1.4 Infringement: Content violating third-party intellectual property rights.

12.1.5 Illegal Goods: Content promoting the sale of illegal drugs or weapons.

12.2 Content Moderation & Reporting (DSA)

12.2.1 Reporting: You may report illegal content via the in-app "Report" function. We will review such reports in a timely, diligent, and objective manner.

12.2.2 Detection Measures: We may use automated technical means to detect illegal content (e.g., hashing databases for CSAM or Terrorist Content). If content is removed for terrorism-related reasons, we will preserve the related data for six (6) months for law enforcement purposes, as required by law.

12.2.3 Trusted Flaggers: Notices submitted by certified "Trusted Flaggers" (designated under the DSA) will be processed with priority.

12.2.4 Misuse: We reserve the right to suspend the processing of notices from users who frequently submit manifestly unfounded reports or complaints.

12.3 Statement of Reasons

If Leaptic restricts visibility, removes content, or suspends your account, we will provide a Statement of Reasons explaining:

12.3.1 The specific legal or contractual ground for the decision;

12.3.2 The facts relied upon; and

12.3.3 Whether the decision was taken using automated means (e.g., AI detection filters).

12.4 Complaint Handling & Redress

12.4.1 Internal Complaint System: If you disagree with a moderation decision, you may lodge a complaint free of charge via our internal system within six (6) months of the decision. Decisions will be reviewed under the supervision of qualified staff, not solely by algorithms.

12.4.2 Out-of-Court Dispute Settlement: You are entitled to select a certified out-of-court dispute settlement body to resolve disputes relating to content moderation decisions, in accordance with Article 21 of the DSA.

12.5 No General Monitoring Obligation

Without prejudice to our obligations to take specific measures against terrorist content under Regulation (EU) 2021/784, you acknowledge that Leaptic is under no general obligation to monitor the information which it transmits or stores, nor to actively seek facts or circumstances indicating illegal activity.

12.6 Copyright & OCSSP Status

To the extent Leaptic qualifies as an Online Content-Sharing Service Provider (OCSSP) under Directive (EU) 2019/790, we employ "best efforts" to obtain authorizations for content and to ensure the unavailability of specific unauthorized works identified by rights holders.

12.6.1 Upload Filters: You acknowledge that User Content may be subject to automated recognition technologies (e.g., fingerprinting) to prevent the upload of copyrighted material for which Leaptic does not hold a license.

12.6.2 Redress: If your content is blocked by these filters, you may file a complaint via the in-app notification to request human review.

13. RIGHT OF WITHDRAWAL (EU CONSUMERS)

This Section 13 applies ONLY to digital services purchased directly within the App or via our software portal. It does NOT apply to the return of physical goods (e.g., Leaptic Cameras). Returns of physical hardware are governed by the Terms of Sale provided at the time of your hardware purchase or available on our website.

13.1 Statutory Right (Digital Services Only)

If you are an EU consumer, you have the right to withdraw from contracts for Paid Digital Services (e.g., a Premium App Subscription purchased via the Website) within 14 days of purchase without giving a reason. However, how you exercise this right depends on how you purchased the Service.

13.2 Purchases via App Stores (Apple/Google)

If you purchased a subscription or digital item via a third-party App Store (e.g., Apple App Store or Google Play Store), you must exercise your right of withdrawal directly with that App Store. Leaptic does not have the ability to process refunds for transactions made through third-party payment processors. Please refer to the Terms of Service of Apple or Google for instructions on how to request a refund.

13.3 Direct Purchases (Web/ Digital)

If you purchased a Digital Service (not hardware) directly from Leaptic (e.g., via our website), you may exercise your right of withdrawal by contacting us using the Model Withdrawal Form in Annex A or by sending an unequivocal statement to our support email within the 14-day period.

13.4 Waiver for Digital Content (The App & Virtual Items)

IMPORTANT: By downloading the App or purchasing digital items (e.g., filters, effects) that are supplied immediately, you expressly consent to the immediate performance of the contract and acknowledge that you thereby lose your right of withdrawal once the download or supply has begun. You will not be eligible for a refund for such digital content.

13.5 Exercise of Right

To exercise the right of withdrawal for eligible services (e.g., renewable subscriptions), you must inform us of your decision by an unequivocal statement (e.g., a letter sent by post or email). You may use the Model Withdrawal Form provided in Annex A of these Terms, but it is not obligatory.

14. CONFORMITY OF DIGITAL SERVICES

14.1 Legal Guarantee

For EU consumers, Leaptic warrants that the App will be in conformity with the contract (i.e., fit for purpose, possessing the quality and performance normal for apps of the same type) upon supply.

14.2 Updates and Digital Environment

14.2.1 App Updates: Leaptic will provide security and conformity updates for the App for a period reasonably expected by the consumer. You are responsible for installing these updates within a reasonable time. Leaptic shall not be liable for any lack of conformity resulting solely from your failure to install the relevant update, provided we informed you of the update's availability and the consequences of failing to install it.

14.2.2 Device Compatibility: You acknowledge that the App requires a compatible mobile device and operating system (OS). Leaptic is not liable for any lack of conformity or errors caused by your failure to update your mobile device’s OS to the minimum requirements, or by your failure to install a supplied App update within a reasonable time.

15. LIMITATION OF LIABILITY

15.1 Mandatory Liability (The "Carve-Out")

Nothing in these Terms excludes or limits Leaptic’s liability for:

15.1.1 Death or personal injury caused by our negligence;

15.1.2 Fraud or fraudulent misrepresentation;

15.1.3 Intentional misconduct or gross negligence; or

15.1.4 Any other liability that cannot be excluded or limited under applicable EU member state laws (such as statutory guarantees for product conformity under Directive (EU) 2019/770).

15.2 Limitations

Subject to Section 15.1, Leaptic shall not be liable for:

15.2.1 Data Loss: Loss of photos, videos, or content stored locally on your device. You are solely responsible for backing up your data to a separate device or cloud service;

15.2.2 Business Losses: Loss of profit, loss of business, business interruption, or loss of business opportunity (as the App is intended for consumer use);

15.2.3 Third-Party Actions: Damages caused by third-party services, links, or unauthorized access to your account resulting from your failure to safeguard login credentials;

15.2.4 Foreseeability: Any loss or damage that was not foreseeable to both you and us at the time these Terms were agreed.

15.3 Financial Cap

To the maximum extent permitted by applicable law, Leaptic’s total aggregate liability to you for all claims arising out of or relating to these Terms or the Services shall be limited to the amount you paid to Leaptic for the App or related paid services in the twelve (12) months preceding the claim, or fifty Euros (€50.00), whichever is higher.

16. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Leaptic, its affiliates, and their respective officers, directors, and employees from and against any third-party claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from your negligent or intentional:

16.1 Use of the App in violation of these Terms or applicable law;

16.2 Uploading of User Content (e.g., claims that your video infringes a third party’s copyright or privacy rights); or

16.3 Violation of any third-party rights. This indemnity does not apply to the extent the claim arises solely from Leaptic’s negligence or breach of statutory duty.

17. TERMINATION AND SUSPENSION

17.1 Termination by You

You may terminate these Terms at any time by deleting your Account and uninstalling the App. Upon termination, you may request the erasure of your personal data in accordance with our Privacy Policy and the GDPR ("Right to be Forgotten").

17.2 Termination/Suspension by Leaptic (Modular Approach)

We may limit, suspend, or terminate your access to the Services if you violate these Terms, the Community Standards, or applicable laws.

17.2.1 Tiered Sanctions (Proportionality): Depending on the severity of the violation, we may: (1) Issue a warning; (2) Remove specific User Content; (3) Suspend access to the Social Community (Platform) features; or (4) Permanently terminate your Account.

17.2.2 Hardware Decoupling (Preservation of Local Tool): You acknowledge that a suspension or termination of your Account (Social Community access) due to a violation of Community Standards does not terminate your license to use the App as a local controller for your Leaptic Camera ("Local Tool Mode"), nor does it affect your ownership of the hardware. However, Leaptic reserves the right to terminate the entire App license only if your conduct poses a technical security threat to the App, the firmware, or other users (e.g., injecting malware or attempting to brick the system).

17.3 Statement of Reasons

If we restrict or terminate your access, we will provide you with a Statement of Reasons in accordance with the procedures and exceptions described in Section 12.3.

18. APP STORES AND THIRD-PARTY LINKS

18.1 Third-Party Links

The App may contain links to third-party websites or resources. Leaptic is not responsible for the availability or content of such third-party services.

18.2 App Store Terms

If you downloaded the App from the Apple App Store or Google Play:

18.2.1 You acknowledge that these Terms are between you and Leaptic, not Apple or Google;

18.2.2 Apple and Google are third-party beneficiaries of these Terms and have the right to enforce them against you;

18.2.3 You must comply with applicable third-party terms of agreement (e.g., your wireless data service agreement) when using the App.

19. EXPORT CONTROLS AND SANCTIONS

You represent and warrant that:

19.1 You are not located in a country that is subject to a U.S. or EU government embargo, or that has been designated as a "terrorist supporting" country; and

19.2 You are not listed on any U.S. or EU government list of prohibited or restricted parties (e.g., the U.S. Entity List). You agree not to export, re-export, or transfer the App or its underlying software to any prohibited jurisdiction or person.

20. GOVERNING LAW

20.1 Jurisdiction

These Terms are governed by the laws of PRC.

20.2 EU Consumer Protection Override

Notwithstanding Section 20.1, if you are a consumer habitually resident in the European Union, you also enjoy the protection of the mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights to rely on such mandatory local laws (e.g., warranty rights).

21. DISPUTE RESOLUTION

21.1 Amicable Resolution

If you have a complaint, please contact us first at 【gzyqgf@leaptic.tech】. We will attempt to resolve the issue informally within a reasonable timeframe.

21.2 Alternative Dispute Resolution (ADR)

If we cannot resolve the dispute, you may refer the matter to a certified Alternative Dispute Resolution (ADR) entity in your country.

21.2.1 Note regarding ODR: Please note that the European Online Dispute Resolution (ODR) platform (previously accessible at ec.europa.eu/odr) has been discontinued by the European Commission. Consequently, Leaptic does not participate in dispute resolution procedures via the ODR platform. Please contact the certified ADR body competent for your country of residence directly.

21.3 Judicial Redress

You may bring legal proceedings in the courts of PRC or, if you are an EU consumer, in the competent courts of the Member State where you reside.

22. CHANGES TO THESE TERMS

We may update these Terms or the App features for valid reasons, including: (a) compliance with legal or regulatory requirements; (b) security updates; (c) preventing abuse; or (d) improving product features.

22.1 Material Changes

For changes that significantly disadvantage you (e.g., price increases, reduced features), we will provide reasonable advance notice. You have the right to terminate your account if you do not agree.

22.2 Minor Changes

For updates addressing security, bug fixes, or legal compliance, changes may take effect immediately. Continued use of the App constitutes acceptance of the changes.

24. FEEDBACK

24.1 Providing Feedback is entirely voluntary; and

24.2 You grant Leaptic a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, commercialize, and otherwise exploit such Feedback for any purpose (including improving the App or developing new products) without any obligation to compensate you or credit you.

25. GENERAL PROVISIONS

25.1 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without Leaptic’s prior written consent. Leaptic may assign or transfer these Terms, at its sole discretion, without restriction.

25.2 Entire Agreement

Except as otherwise stated herein, these Terms constitute the entire and exclusive understanding and agreement between Leaptic and you regarding the Service, and these Terms supersede and replace any and all prior oral or written understandings or agreements.

25.3 Severability
